Tom Cruise won't file charges against trespasser

Jason Sullivan, the man who was arrested for trespassing on the property of actor Tom Cruise, will not face charges for that transgression.

TMZ reported that the case will likely be referred to the District Attorney of L.A. County.

Sullivan, a model from Australia, lived next door to Cruises agent Kevin Huvane. He reportedly mistook the actors property for Huvanes Sunday evening and, while intoxicated, began to enter the grounds. After Cruises security repeatedly warned him to leave, Sullivan was tasered before being arrested and cited for misdemeanor trespassing.

"Upon arrival, officers contacted a lone male suspect who was attempting to leave the location. The suspect had been previously detained by a security officer, who was on duty at the residence and had observed the suspect climbing a fence to gain access to the property," Beverly Hills Police said, according to the Los Angeles Times.

Sullivan was subsequently released.

"Tom's not a vindictive guy," said the actors lawyer, Bert Fields. "The guy was drunk. He didn't have a malicious intent."

Cruise and his family members were not at home when the incident occurred, which was around 9:35pm.
